Community Plat-Forums For Earthwork + For Spirit PeopleEarthbound Elements For Earthwork LLC® is the sole and exclusive owner, operator, designer, creator and administrator of the Community Plat-Forums For Earthwork + For Spirit People, an exclusive paid membership subscription service, including without limitation all associated content, materials, discussions, branding, trademarks, service marks, logos, designs, graphics, software, technology, processes, databases and intellectual property.
By enrolling in and accessing the Community Plat-Forums For Earthwork + For Spirit People, an exclusive paid membership subscription service, you agree to the following Terms of Service + Terms and Conditions.
Exclusive paid membership access is granted on a subscription basis subject to payment of applicable fees, which are billed in advance on a recurring basis (monthly or quarterly as selected) and are non-refundable. Failure to maintain current payment may result in suspension or termination of access.

11. PaymentAll prices are listed in U.S. dollars unless otherwise stated. Payment is required before services are provided or products are shipped. You agree to our Refund + Cancellation Policy before purchasing.
All payments for product goods, memberships, digital products, events or services are due at time of purchase. Membership subscriptions to Earthbound Elements For Earthwork LLC® and the Community Plat-Forums For Earthwork + For Spirit People are monthly or quarterly payments that are non-refundable unless explicitly stated. We reserve the right to change pricing at any time. Failure to have a payment processed will result in suspension or termination of access to the subscription.
12. Refund Policy
Earthbound Elements For Earthwork LLC® strives to ensure quality product, services and membership subscriptions to satisfaction to all of our customers. Customer service is our number one priority.
All exclusive paid memberships subscriptions to the Community Plat-Forums For Earthwork, operated by Earthbound Elements For Earthwork LLC® are sold as digital, subscription-based services and not as tangible goods, therefore, all exclusive paid membership fees are non-refundable once payment has been processed and access to the Community Plat-Forums For Earthwork has been granted. The exclusive paid members receive access to proprietary digital content, community resources and exclusive materials upon enrollment and an approval process with a registered username and password, no returns, partial refunds, or website credits will be issued for unused time, lack of participation, dissatisfaction or early cancellation. Members may cancel their subscription at any time prior to the next billing cycle to prevent future charges, however, cancellation does not entitle the member to a refund of previously paid fees and access will continue through the end of the current paid term. In the event of duplicate billing or verified processing errors, Earthbound Elements For Earthwork LLC® will review and, if appropriate, issue corrections or refunds at its sole discretion. Earthbound Elements For Earthwork LLC® reserves the right to modify this Return Policy at any time and continued membership constitutes acceptance of the current policy.
If a product good does not meet satisfaction or if it is damaged during shipping, contact us immediately within 72 hours of receiving the product.
If you are returning product goods, you will be responsible for the return shipping costs unless the product good has been damaged during shipment or if the wrong product good has been shipped in error. We strongly advise return shipments with a tracking number, as we will not take responsibility for any lost product good.
Candles must be unburned to receive a refund or replacement.
Due to the nature of some of our product goods and services, all audio/video, community and any other digital services sales are final. No refunds will be issued. Please review all product and service details carefully before purchasing.
We reserve the right to refuse any return if it does not meet these guidelines. All sales are non-refundable.
Purchases of Dayna Lee’s book, Trust Your Path to Be, are subject to the refund policies of the distributor through which the book was purchased.

18. Client Agreement + Informed Consent Contract
Participation in any services For Earthwork requires a signed Client Agreement + Informed Consent Contract. Services cannot and will not be provided without a completed, signed agreement on file. The digital .PDF file format is ready for E-Sign and will be delivered via e-mail after the service purchase. If the e-mail is not in your inbox within 24 hours, it may have been filtered to your spam folder.
19. Fulfillment upon Scheduling
An order is considered fulfilled and completed once the service purchase has been scheduled and confirmed by the client through the scheduling process with a confirmation e-mail or written agreement.
During the scheduling process:
○ The service is deemed delivered and reserved exclusively for the client
○ The client acknowledges that preparation time, reserved availability and administrative processing is considered performance of the service
○ The purchase becomes non-refundable
Failure to attend, reschedule, respond or appear for the scheduled appointment (including late arrivals, client cancellation or no shows) does not consider to be non-delivery of the service purchase by Earthbound Elements For Earthwork LLC® and does not create eligibility for a refund or chargeback of any kind.
The client is solely responsible for providing accurate contact information and attending the scheduled appointment. Missed sessions are considered voluntarily forfeited services.
20. Confidentiality and Non-Distribution of Audio/Video Sessions
Any Intuitive Psychic Readings in Audio provided by Dayna Lee Smith of Earthbound Elements For Earthwork LLC® are issued with an automatic Cease and Desist Notice. By purchasing, receiving or accessing an audio reading, the client acknowledges that the content is private, confidential and for the sole personal use of the client. Clients are expressly prohibited from recording, distributing, publishing, reproducing, sharing, selling or otherwise disseminating any portion of an audio or video session in any format, including but not limited to social media, websites, messaging platforms or third-party services, without prior written consent from Dayna Lee Smith.
Any unauthorized recording, sharing or distribution of any session content will result in an immediate Cease and Desist Notice and may lead to further legal action to protect the intellectual property, privacy and professional services provided by Dayna Lee Smith of Earthbound Elements For Earthwork LLC®.
Any Intuitive Psychic Readings in Virtual 1 on 1 sessions provided by Dayna Lee Smith of Earthbound Elements For Earthwork LLC® are conducted live and are recorded, but not provided to the client in audio or video format.
By participating in an audio reading or virtual session, the client acknowledges and agrees to these confidentiality and non-distribution Terms of Service + Terms and Conditions.
21. Third-Party Links + Services
Some of our products and/or areas of the website may link to other services and websites. We are not responsible for their privacy practices.
Dayna Lee’s book, Trust Your Path to Be, purchases may occur through third-party retailers (example: Amazon, etc.). Those platforms have their own privacy policies.
22. Third-Party Product + Shipping
By using this website and placing an order, you agree that all products are made-to-order and fulfilled by our third-party production partner, Printful. Due to the nature of on-demand production, minor variations in color, size, materials and print placement may occur and do not constitute defects. All sales are considered final once an order enters production and cannot be modified or canceled except at our sole discretion. We are not responsible for delays, lost packages, customs issues or damages caused by shipping carriers or third-party providers. By purchasing from this website, you acknowledge that we are not liable for indirect, incidental or consequential damages related to the use of our products or services. To fulfill orders, we collect necessary customer information such as name, email, billing, and shipping details, which may be shared securely with fulfillment providers, payment processors and shipping carriers solely for order processing and delivery. In the event that a conflict of interest involving any party is identified after a purchase has been completed with Earthbound Elements For Earthwork LLC®, Earthbound Elements For Earthwork LLC® reserves the sole and absolute right to immediately terminate all services related to the order and the order shall be deemed fulfilled with no refunds, credits or reimbursements issued under any circumstances.
